		<description>Why does everyone want to admit that Financial Exploitation is the Crime of the 21st Century yet not dare to mention one of the most horrific forms of this abuse and that is what is happening to seniors and dependent adults in Guardianships.

All over America elderly citizens and dependent adults with assets are forced into involunary guardianships where they lose all their rights and another person (usually a professional guardian) is appointed to control their lives and their assets essentially becoming the alter ego of the supposedly incapacitated adult.

Once these vulnerable citizens estates become exposed to the elements of corruption (as the ward has not say in what is done with their money) greedy professionals line up to line their pockets as the fleecing of the estate commences.

There are hundreds of cases that illustrate that outrageous needless litigation and guardianship fees are racked up at allarming rates and the Probate judges are for the most part rubber stamping the petitions for fees to be paid from the incapacitated persons estate.

This opportunity to get rich off of lucrative guardianships and conservatorships is too tempting and the theft of these estates occurs with impunity.

We believe this is outright financial exploitation. A reputable Study done in early 2008 found that the highest percentage of funds exploited from the elderly in their study was done by professionals.

Many vulnerable citizens are not only robbed of their estates and their heirs robbed of their inheiritance but they are also neglected and put into to abusive situations. They are often forced from their homes and put into living conditions they would never choose so their homes can be sold. Their families are ripped apart and those who complain about a guardian&#039;s treatment of their loved one are separated from them and refused the right to even visit them.

It is time to address this horrific silent crime that is the ultimate disgrace.

		<description>My friend Max passed away Dec.6 2009 in Alabama he worked for a government agency for over 20 years in Orlando Fla.  He was over 70 did not have the money to enjoy his elder years had to work His last year at his job  his acting  Supervisor for the past year harrased him about retirement almost every day Max was not the only one that was harrassed  JR. JOE Jim who are over 60  Max ask me not to say nothing because it might hurt him I said ok  BUT it hurt me to see him treated that way he was a good man he should have not been treated like that by a supervisor or any one else but he was I dont know what to do where to go or if any one cared now he is gone  he is in a better place but WHY do people do this to people I was rased to respect my elders but there is not any one cares</description>

		<description>It is very difficult even as a professional to protect our parents from abuse epecially when   my mom has been very secretive and controlling with all of her 5 children all of our lives. This breeds a huge amount of jealousy, confusion, and mistrust among the  siblings which then makes the parent become confused and unknowing of who to trust.
In order to make a very sad and long story shorter because it is not over yet. 

I am the eldest of my siblings as well as an RN who enjoy providing care to elders and advocating on their behalf. Myself and 3 of my siblings live in Michigan and the siaster in question lives in Ohio. This sister took advantage of my mother&#039;s trust in her and was able to get my mother to move all of her money out of an account she has had for over 30 yrs into another account. Then my sister took my mother&#039;s money and for a long while we did not know where my mother&#039;s money was. Protective service determined my mother was not being abuse because my sister was paying all of her bills, she was neat and clean and had food to eat. My sister was able to trick my mother into giving her power of attorney and get her Dr to declare that she was incompetent. My sister is not the one here that my mother depends on. I take her to all of her Dr&#039;s apts and set up her meds etc. We recently found out that my sister put my mother&#039;s money into an annuity in her name. It is not in my mother&#039;s name and she put my youngest sister as the beneficiary. We are fighting my sister for trying to obtain guardianship and trying to get the money back into my mother&#039;s control.
I realize it sounds like my mom is incompetent but she isnt. My sisters would like to treat her as if she is but I encourage her independence. She was continuing to work up until last year when she became ill but she is fine now and able to continue to care for herself with minimal asistance.
My sister claims that what she has done is legal. But it is only by the Grace of God that my mom is still here because it has been one devastating experience and betrayal after another. My sister even tried to get my mom to move to Ohio and put her in a nursing home. My sister is not here to see how this has affected my mom&#039;s ability to tust and to sleep at night. She worries. But my sister thinks she&#039;s protecting my mother. At first she told my mom she was not getting a condo. But finally I was able to convince her to give the money needed for my mother to purchase the condo. My mom has told my sister, the court , protective services and the attorneys that she wants to be in control of her own finanaces. In the meantime, my mother&#039;s money is being wasted on attorney fees and she lost money moving cd&#039;s that had not yet matured, as well as the annuity that we just found out that is not in my mother&#039;s name. My sister justifies her actions by indicating that my mom gets social security and she pays all of her bills so she doesn&#039;t need any more money than that. This is why she says she took it upon herself to put my mother&#039;s money in annuity  in my sister&#039;s name that is based on my sister&#039;s age being eaten up in insurance!</description>

		<description>It seems there are many groups tackling this issue. I think it would be better for all the groups to unite and then have one strong voice. There should be a national organization supported by members (individuals) so the politicians see our numbers. Just look at the National Rifle Association as an example. Right now, politicians see a patchwork of elder abuse groups and no membership to speak of. And regarding the Elder Justice Act, while it&#039;s a step in the right direction, I want to see changes to how banks do business. When I study how my brother was able to steal $30K from my mother, I see holes that need to be plugged. I have a list of nine items which would have prevented the looting. So, I&#039;d like someone to take charge and unite everyone and get a membership supported organization, with a lobbying group, that Washington will understand. It shouldn&#039;t take 25-30 years for this to be solved.</description>

		<description>It is unconscionable that Congress has held hearings on the horrors of elder abuse for over 30 years and has yet to pass a single comprehensive law to address it. This is in sharp contrast to the dozens of laws and $9 billion in funds addressing child abuse as well as the half billion provided to battered women&#039;s and rape crisis services under the Violence Against Women Act - all of which are needed and well deserved. But while our seniors fought to protect our country and to build the prosperity we have long enjoyed, our national lawmakers have been content to ignore their suffering at the hands of their own family members, caregivers and others. As a result, one in nine older persons is abused (hit, punched, burned), neglected (left to lie in their own waste, not fed or given water) and financially exploited in the billions of dollars every year without a penny of designated funding from the federal government. Adult Protective Services (APS) are the &quot;boots on the ground&quot; in the fight against elder abuse, as they are the people who go into seniors&#039; homes to investigate the abuse and to offer protection. PASS THE ELDER JUSTICE ACT TO HELP WOEFULLY UNDERFUNDED STATE AND LOCAL APS PROGRAMS SO THEY CAN RESPOND TO AND PROTECT OUR ELDERS! Thank you! If justice delayed is justice denied,  30 years with no action is a grave injustice to the people we say we honor and respect.</description>

		<description>Financial abuse is like a cancer. It starts so quietly and is hardly noticed. In my case, the biggest problem is my brother (the thief) lives in the same house with her. He has access to her mail and all financial documents (she&#039;s now mostly blind). He&#039;s easily spent $30K of her money. My whole story is at my blog (the family thief) which I published so others may learn. As I&#039;ve discovered, it&#039;s very difficult to take action when the victim doesn&#039;t realize what&#039;s happening and then is afraid to report it (after being told of the theft). I feel my hands are tied.</description>
